Terms & Conditions

1. Definitions

  • "Beniferro" means the company that sells the swimming pool antimanagement products.

  • "Buyer" means the person or entity that purchases the swimming pool water management products.

  • "Products" means the swimming pool water management products that are sold by Beniferro.

  • "Website" means the website where the Products are sold.

2. Acceptance of Terms and Conditions

By placing an order for Products on the Website, the Buyer agrees to be bound by these Terms and Conditions. If the Buyer does not agree to these Terms and Conditions, they should not place an order for Products on the Website.

3. Order Process

The Buyer can place an order for Products on the Website by following the instructions on the Website. The Buyer will be required to provide their personal details, including their name, address, and email address. The Buyer will also be required to select the Products that they wish to purchase and the quantity of each Product.

Once the Buyer has placed an order, Beniferro will send an email to the Buyer confirming the order. The email will contain the details of the order, including the Products that have been ordered, the quantity of each Product, and the price of the Products.

4. Payment

The Buyer can pay for Products by credit card or PayPal. The Buyer's credit card or PayPal account will be charged when the order is placed.

5. Delivery

Beniferro will deliver the Products to the Buyer's address. The delivery time will vary depending on the location of the Buyer.

6. Returns and Refunds

The Buyer has the right to return non-defective Products to Beniferro for a refund within 14 days of the date of delivery. The Products must be returned in their original condition and packaging.

Beniferro will refund the Buyer the full amount of the purchase price, minus the cost of the return delivery. The refund will be processed within 14 days of the date that the Products are returned to Beniferro. 

Beniferro accept exchanges or will replace detective products that are within the warranty period and this will include covering the cost for the delivery and return delivery cost if applicable.   

7. Liability

Beniferro is not liable for any loss or damage that is caused by the Products. The Buyer is responsible for using the Products in a safe and responsible manner.

8. Governing Law

These Terms and Conditions will be governed by and construed in accordance with the laws of the State of South Australia.

9. Entire Agreement

These Terms and Conditions constitute the entire agreement between Beniferro and the Buyer and supersede all prior agreements, representations, and understandings between the parties, whether written or oral.

10. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision will be struck from these Terms and Conditions and the remaining provisions will remain in full force and effect.

11. Waiver

No waiver of any provision of these Terms and Conditions will be effective unless in writing and signed by both parties.

12. Notices

Any notices or other communications under these Terms and Conditions will be in writing and will be deemed to have been duly given when delivered in person, upon the first business day following deposit in the mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

or to such other address as either party may designate in writing from time to time.

13. Headings

The headings in these Terms and Conditions are for convenience only and will not affect their interpretation.

14. Counterparts

These Terms and Conditions may be executed in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument.

15. Language

These Terms and Conditions are in the English language and will not be translated into any other language.

16. Governing Law

These Terms and Conditions will be governed by and construed in accordance with the laws of the State of South Australia.

17. Dispute Resolution

Any dispute arising out of or relating to these Terms and Conditions will be finally settled by arbitration in accordance with the rules of the International Chamber of Commerce. The arbitration will be held in Adelaide, South Australia and the language of the arbitration will be English.
